Zarty Points Program Terms

In these Zarty Point Program Terms (“Program Terms”), you will find important information about how to earn points, what the points can be redeemed for, and our ability to make changes to the Zarty Points Program Terms.

"We", "our" or "us" refers to Zarty LLC. "You" or "your" refers to you. All capitalized terms used herein and not otherwise defined in these Program Terms will have the meanings set forth in the Terms of Use Agreement.

All eligible customers must enroll via the Zarty Application. By enrolling in the Zarty Points Program (“Zarty Points”), you are accepting the Zarty Points Program Terms, and agree that you:
1. Are at least 18 years old, or the age of majority in your jurisdiction, whichever is greater;
2. Read and understood these Program Terms;
3. Are able to download the Zarty App on your mobile device; and
4. Are a resident of the United States.

Eligibility for Zarty Points
Membership is free and available to individuals with a valid address in the United States that download the Zarty App and create a free account. Corporations, associations and other groups may not participate. We reserve the right to disqualify any person from participating if, in our sole judgment, that person appears to be violating these Program Terms or the Terms of Use Agreement, making purchases for a business or for resale, manipulating the Zarty Points program, making excessive returns or otherwise acting in a manner inconsistent with the Zarty Points program’s intent. If a member is disqualified, they forfeit their Points account value and all outstanding balances.

Overview of Zarty Points
‍Zarty Points is a rewards program for Zarty users that offers Points for each product tested by the user. Points have no monetary value and may not be exchanged for anything of value. Users can get points by uploading their receipts and thoughtfully answering questions about the product they are reviewing. A follow up survey may automatically become available to a user within 2-4 weeks. When you complete the steps outlined by Zarty, in Zarty’s sole discretion, you will receive the associated number of Points. Returns and other adjustments, such as a price adjustment, may reduce or eliminate your Points account balance.

Managing Your Account
You can view your account's Points balance, what Points can be redeemed for, and manage your Zarty Points account from the Zarty App. By enrolling in Zarty Points and participating in the program, you agree that we may send you information about Zarty Points via email, mail, text or push notifications through the Zarty App on your smartphone or tablet. You may opt-out or unsubscribe at any time by [emailing: Support@zarty.com]. Any enrolled Zarty Points members may receive additional rewards or Points from time to time.

Rewards Available
Rewards available may change at any time based on availability. Each reward will have its own terms that apply, which may include an expiration date or require you to share information with the company offering the reward. We are not responsible for any content or rewards provided by any rewards provider. The information you provide to the rewards provider to claim or use a reward is subject to the privacy policy of the rewards provider. When you claim and use a reward, you release Zarty and all of its affiliates from liability for your claim and/or usage, and for your participation in Zarty Points.

Termination or Changes to Your Zarty Points Program Account
‍If you terminate your Zarty Account, your Rewards account will be closed and you will forfeit any Points. We may monitor your activity for compliance with the Program Terms. We can suspend or terminate your Zarty Account at any time in our sole discretion. You may lose Points or the ability to claim rewards in your Zarty account if your account status changes, we suspect fraudulent activity, or we make changes to the Zarty Points program. We may change these Program Terms at any time. You may access the Program Terms on the Zarty App to review changes to Program Terms. If you continue to remain in the Zarty Points program after the program or Program Terms change, it means you are accepting the changes to the Zarty Points program and the Program Terms.

We may terminate the Zarty Points program at any time, with or without notice, which may result in loss of accumulated Points account value and the cancellation of all benefits and privileges associated with the Zarty Points program. We reserve the right to limit, delete or change any of the rules, terms, conditions, and benefits of the Zarty Points program at our sole discretion, with or without notice. Interpretation of these Program Terms shall be at our sole discretion, whose decision will be final. We have the right to close your Points account for any reason.

Limitation of Liability
You and we agree to limit claims against each other for damages or other monetary relief to direct damages. This limitation and waiver will apply regardless of the theory of liability. This limitation of liability also applies if you bring a claim against the companies offering rewards, to the extent we would be required to indemnify those companies against any claims. You agree we are not responsible for problems caused by the company providing the reward or the event sponsor, you, others, or by any act of God.

Miscellaneous
We are not responsible for lost, destroyed, stolen or expired points. Any tax liability connected with receipt or use of any Points is your sole responsibility. Program void where prohibited by law. A Points account balance is not transferable in the event of death, as part of a domestic relations matter, or for any other reason. The sale or barter of any Points account balance is prohibited. Events beyond our control, such as computer equipment or electronic data transmission failure, strikes, acts of God, civil disturbance, pandemics, epidemics, terrorism or war, which may affect our ability to perform, will allow us to suspend or terminate the Zarty Points program.

By enrolling in the Zarty Points program, you consent to the release of information to third parties to carry out the Zarty Points program.

You must advise us of any change in your name or the address, phone number and/or email address associated with your Points account. Please email support@zarty.com to update this information. We are not liable for any issues arising from your failure to update your contact information

These Program Terms are governed by Florida state law, without reference to conflicts of law doctrine, as such law is applied to agreements entered into and performed entirely within such jurisdiction.

By participating in Zarty Points, you further accept and agree to be bound by our Terms of Use Agreement and Privacy Policy. In the event of any conflict between these Program Terms and the Terms of Use Agreement, the language in the Terms of Use Agreement shall apply.

If any part or parts of these Program Terms are found under the law to be invalid or unenforceable, then such specific part or parts shall be of no force and effect and shall be severed and the remainder of the Program Terms shall continue in full force and effect.
