The Zarty® Sweepstakes (the “Sweepstakes”) is subject to applicable federal, state, local and municipal laws and regulations. Void where prohibited or restricted by law. Zarty LLC (“Sponsor”) reserves the right to cancel, terminate, modify, or suspend the Sweepstakes at any time if it determines, in its sole discretion.

Eligibility: This Sweepstakes is open only to those who enter via Instagram or www.zarty.com/sweepstakes or www.zarty.com/sign-up/joy and who are 18 years or older as of the date of entry. The Sweepstakes is only open to legal residents of the United States and is void where prohibited by law. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

Sweepstakes Entry Period: Entries will be accepted via Instagram or at www.zarty.com/sweepstakes or www.zarty.com/sign-up/joy from October 11th, 12:00pm ET to October 18th, 11:59pm ET.

How to Enter: The Sweepstakes must be entered during the Sweepstakes Entry Period via Instagram posts sponsored by Zarty, www.zarty.com/sweepstakes or www.zarty.com/sign-up/joy. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. Limit of one entry per person for the Sweepstakes. Multiple entries may be submitted from the same IP address or device, so long as each entry is in the name of, and in fact for the benefit of, a separate natural person. Sponsor may use automated means of determining whether multiple entries from the same IP address or device are suspicious.

Prizes: The Winner(s) of the Sweepstakes (the “Winner”) will receive $500 in Walmart Gift Cards. The specifics of the prize shall be solely determined by Sponsor. No other prize substitution shall be permitted except at Sponsor’s discretion. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others by Winner is permitted. Acceptance of prize constitutes permission for Sponsor to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. All guarantees and warranties are subject to the manufacturers or service provider’s terms and conditions, and the winner agrees to look solely to such entity for any such warranty or guarantee claim.

Odds of Winning: The odds of winning depend on the number of eligible entries received during the Sweepstakes Entry Period.

Winner Selection and Notification: Winner will be selected by a random drawing, conducted under the supervision of Sponsor approximately 2 days after the end of the Sweepstakes Entry Period. Winner will be notified by email or Instagram direct message within five (5) days following selection of the Winner. Sponsor shall have no liability for Winner’s failure to receive notices due to failure of the Internet or other public utilities, networks and infrastructure, the spam or other security settings of Winner or any third party, or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (as determined by Sponsor at Sponsor’s sole discretion) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering the Sweepstakes, you (“You”) understand and agree that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns, shall have the right, except where prohibited by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such a case, Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

Limitation of Liability: By entering, You agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners,representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur,directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the South District of Florida or the appropriate Florida State Court located in Palm Beach County, Florida; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction),which would cause the application of the laws of any jurisdiction other than the State of Florida.

Agreement to Rules: By participating, You agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Sponsor as final and binding as it relates to the content of this Sweepstakes.

Winners List. To obtain a copy of these Official Rules or for notification of the winners, send a self-addressed stamped envelope to: Zarty LLC - of 205 Worth Ave, Suite 210, Palm Beach, FL 33480. Requests for winners’ lists must be received no later than three months after the end of the Sweepstakes Entry Period.
